The Lawsuits against ACCS
The first class action lawsuit challenging ACCS’s collection practices was filed in 2000. Since then, ACCS has never won, but it has been able to stall the lawsuits to avoid a final decision. In January 2009, it looked like the courts in Florida and California were finally going to rule. To avoid this, on January 19, 2009, ACCS filed a bankruptcy petition in Delaware. ACCS filed this to stop the lawsuits, not because it was running out of money. Right now, ACCS and its financial partners are trying to engineer the creation of a new company that will not have to face the current lawsuits. Consumers will then have to start over with new lawsuits to stop ACCS’s abusive collection practices.
IF YOU ARE SOMEONE TO WHOM ACCS SENT ONE OF ITS COLLECTION DEMANDS, YOU SHOULD HAVE RECENTLY RECEIVED A NOTICE OF THE BANKRUPTCY IN THE MAIL. If you did not, please contact us and give us your name, address, and when you were previously contacted by ACCS.
